shipping handling
All ATVs will be shipped freight by Day and Ross. Please refer to their website (www.dayross.ca) for terminal locations or you can email us. All ATVs will be shipped to your nearest shipping terminal ONLY (If you require home delivery, it can be arranged for additional funds, so please do contact us. We can also use other carriers if required) . Delivery can be made to your location only if the following conditions are met:
Business address with a loading dock or
Forklift available to take shipment off truck
If the ATV is going to be delivered to a business address, please include your correct business address, contact name and business phone number during checkout. If you have a business address that is outside of the Day and Ross service area, extra charges will apply. Please be sure to include all correct information as this will help to expedite the transaction. Failure to do so will result in delays.
The customer is responsible for picking up the ATV at the nearest shipping terminal. As soon as the shipment arrives at the terminal, Day and Ross will contact you via telephone to let you know it is available for pickup. In addition, tracking information will also be provided- so please do send us an email to request these details. PLEASE PICK UP THE ATV WITHIN 1-2 DAYS FROM WHEN DAY AND ROSS CALLS YOU. ANY ADDITIONAL TIME, YOU WILL BE PAYING FOR STORAGE!
The Mini ATV is not very heavy. You only need 2 strong people that are capable of pulling it off the truck. Residential delivery is additional, however you will not need to pay tailgate charges if you are unloading by hand.
Tailgate cost is around $69.95 CAD and Residential Delivery is $35.95 CAD. You are responsible for coordinating a residential delivery as well as paying these extras costs directly to Day and Ross. I can also arrange this.
Most shipments will be delivered to a terminal between 1 to 50kms away from the customers home. In the event you live too far from a shipping terminal, you can coordinate with them yourself to have it delivered to your home. These charges are additional and must be paid by you.

Customers from NFLD AND BC please add 40 CAD to shipping cost. Unit will not ship until this fee is received. Thank you

All items are secured tightly inside a steel packaged crate. There are no moving parts inside the box! Rest assured your item will be delivered damage free.
In the event your ATV arrives severely damaged, please contact us and we will provide instructions. Blemishes or scratches do not count as severe damage! Only if your ATV has major damage, contact us.
We ship anywhere in Canada. Customers from Yukon, NWT or Nun please contact us before placing a bid so we can give you an accurate shipping cost.
For those customers who reside in more remote locations such as on an island please do contact us before placing a bid. Additional charges may apply.
Please be advised if you live hundreds of KM away from a Day and Ross terminal, we will gladly use a partner carrier to get the freight as close as possible to you. THIS WILL COST EXTRA.

All GTA residents MUST pick up their package from Keele and Langstaff Rd. If this terminal is your closest one, then you must pick it up from here. THE ATV MUST STILL BE SHIPPED TO THIS LOCATION SO FULL PAYMENT OF SHIPPING AND INSURANCE MUST BE RECEIVED.
ALL PAYMENTS MUST BE RECEIVED BEFOREHAND. WAREHOUSE EMPLOYEES WILL NOT BE ACCEPTING ANY PAYMENTS!! After you win the auction and I will email you with instructions.
Please make sure your vehicle is suitable for picking up the package at the terminal. A cube van or pickup truck is ideal. DO NOT show up in a MINI! Take notice of the dimensions of this unit and plan the pickup vehicle accordingly.
Shipment cost includes administrative fees, warehouse fees, packaging, labor costs, it is not solely shipment cost and is NOT refundable.
Never refuse a shipment for ANY reason. By refusing a shipment, you agree to a 50% refund ONLY when the item returns back to us. Never refuse a shipment for any reason.

Terms of Sale
All sales are final, ATVs are sold as-is. We do not check or inspect ATVs prior to shipment. If you do not understand what as-is means please do not bid. We will not exchange, replace or service ATVs. They are as-is.
We dont replace small parts such as reflectors, screws, bolts, tire caps, washers, etc. Small issues fall under AS IS. For additonal fees, we do carry these parts.
Please understand that we are not mechanics. Contact us only when you know what part you are looking for!
There is VERY LITTLE oil in the engine for shipping purposes. You will need to buy 4 stroke motorcycle oil.
This unit comes with a 1 YEAR warranty on ALL parts as well as a 6 month Warranty on the engine.
Brake pads, tires, timing belts etc, are not covered in the warranty.
All replacement parts will be shipped for FREE during the 1 year period. However, there will be a small handling fee varying from a few dollars to as high as 35- it all depends on what the part is. In some instances, we may cancel this fee.
We are not responsible for any cost that you incur for labor. Waiver of Liability:
I, being above the age of 18 years of age or the parent of a child under the age of 18 years of age, agree to all terms as follows:
I acknowledge and understand that riding an ATV, Go Kart, Mini Chopper, Dirt Bike, Motocycle, Pocket Bike and Gasoline Scooter (from now refered to as SCOOTER(s)) is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders. I understand that these activities can result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, damage or injury while riding these SCOOTERS.
I am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of SCOOTERS as well as those inherent risks, hazards and dangers of personal injury, death and disability. I am aware that the usual risks, hazards and dangers of personal injury and disability increase with inexperience.
I hereby agree to release and forever discharge FM Motorsports Company or it's Parent Company, and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacturer from any and all claims, actions, damages, liability, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to my participation or use of the SCOOTERS, use of equipment or property supplied by FM Motorsports Company or it's parent company or my presence upon the premises, whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, the manufacturer or the distributor. By this AGREEMENT, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from FM Motorsports Company or it's Parent Company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf.
This AGREEMENT shall be affecting and binding upon my heirs, agents, personal representatives and assigns.
I hereby certify that I am over the age of 18 years of age. I have carefully read the foregoing and acknowledge that I understand and AGREE to all of the above terms and conditions. I have had the opportunity to ask any and all questions regarding this AGREEMENT and the affect of the same. I am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk and waive and release certain substantial rights that I may have or possess. I therefore release all liability and waive all rights I may have in regards to my child's activities with the above item(s).
Legal Status of Products:
I have read this waiver of liability, assumption of risk and indemnity agreement, fully understand it's terms, understand that I am giving up substantial rights by agreeing to this waiver and have brought it freely and voluntarily without any inducement, assurance or guarantee being made to me. My purchase is to be considered as a complete and unconditional release of all liability to the greatest extent allowed by law.
Additional Clause for Online Purchases:
All sales are final, no refunds. By refusing a shipment, you agree to pay the shipping cost as listed on this auction as well as a 50% restocking fee, no exceptions. Received the ATV and cant get it to start?
Check the battery, coil, solenoid, 6001A CDI.
If you have received a dead battery it needs to be recharged PROFESSIONALLY.
Do not attempt to recharge it on your own
If problems persist, contact an expert.
